Following
our August 2005 commentary on Thoughtful House, the Texas Medical Board
(formerly the Texas State Board of Medical Examiners)
released minutes of its August licensure committee
meeting, containing information on Dr Arthur
Krigsman, who had applied for a license to
practise in Texas. This followed Krigsman's
resignation in December 2004, blocking official investigations into his conduct at Lenox Hill hospital, New York.
Arthur Krigsman's
license was granted at the Texas meeting following a
letter-writing campaign organised by Thoughtful
House, based around an appeal from Krigsman to
parents, and circulated to anti-vaccine campaigners.

The
meeting was called to order at 10:36 a.m. by Chair,
Thomas D. Kirksey, M.D. Committee members present
were Lee S. Anderson, M.D., Jose Benavides, M.D.,
Melinda S. Fredricks, Eddie J. Miles, Keith E.
Miller, M.D., Elvira Pascua-Lim, M.D., Larry Price,
D.O, Annette P. Raggette and Nancy M. Seliger.

Applicant
# 391 appeared with counsel before the
Committee in executive session after referral by the
Executive Director. In open session, Ms. Raggette
moved to recommend to the full board that the
applicant be allowed to withdraw the application for
licensure, then reapply for licensure and pay a
$5,000 fine, due to disciplinary action by Lenox Hill
Hospital, falsification of application regarding
non-disciplinary citation by Florida, and
misrepresentation regarding entitlement to practice
medicine. Factors contributing to this recommendation
include: one or more violations that involve more
than one patient, repeated or recurring acts,
attempted concealment of the act constituting a
violation (action by Florida Board). A mitigating
factor was that there was no violation of standard of
care. Ms. Seliger seconded.
Dr. Benavides
offered a substitute motion and moved to recommend to
the full board that the applicant be determined
ineligible for licensure due to: disciplinary action
by Lenox Hill Hospital, falsification of application
regarding non-disciplinary citation by Florida,
practicing medicine without a license, and
misrepresentation regarding entitlement to practice
medicine. Factors contributing to this recommendation
include: one or more violations that involve more
than one patient, increased potential for harm to the
public, repeated or recurring acts, attempted
concealment of the act constituting a violation
(action by Florida Board). Dr. Price seconded.
The committee
voted on the substitute motion by Dr. Benavides. Ms.
Fredricks, Mr. Miles, and Dr. Benavides voted in
favor. Ms. Seliger, Ms. Raggette, Dr. Pascua-Lim, Dr.
Price and Dr. Anderson were opposed. The substitute
motion failed on a vote of 3 to 5. The committee then
voted on the main motion by Ms. Raggette. Ms.
Seliger, Dr. Pascua-Lim, Dr. Price, Dr. Anderson, and
Ms. Raggette voted in favor. Dr. Benavides, Ms.
Fredricks, and Mr. Miles were opposed. The motion
passed on a vote of 5 to 3.
